Maruti Suzuki VS Volkswagen Trademark Dispute –


Well, the German manufacturer and India’s top automaker have been locked in a legal dispute for a long time now. And the results are finally here! The Delhi High Court has given the final verdict in favour of Maruti Suzuki. So, what’s this dispute about?


This dispute started back in 2017, when Maruti’s “TRANSFORMOTION” branding appeared in the Trade Marks Journal. After this, Volkswagen filed a lawsuit against the brand for using the “TRANSFORMOTION” branding. Why was Volkswagen so concerned about this? Because the word ‘Transformotion’ is very much close to their “4MOTION” trademark. Just like the 4MOTION, is Maruti’s TRNSFORMOTION another name for its new AWD drive system?

TRANSFORMOTION VS 4MOTION! -Maruti Suzuki VS Volkswagen


Given the context, most of you would expect Maruti to introduce a new AWD system, for which they are seeking the new trademark “Transformotion”. However, it’s not even close to the powertrain; the automaker has been shifting from the analogue instrumentation to digital, which, for marketing purposes, is being termed a transformotion. Volkswagen opposed this trademark because its 4Motion and Maruti’s Tranformotion, ending with ‘Motion’, could cause confusion among buyers.

Final Verdict
As we all know, the final verdict from the Delhi High Court was in favour of Maruti Suzuki. Supporting this court decision is the fact that, even though the endings of both trademarks were the same, their sounds and purposes are completely different. Maruti is using it to label its technological development, and Volkswagen is using it to label its AWD offerings. Also, the wording of both is completely different; it’s very hard for consumers to get confused between them.
